Sociology of Law Research Seminars - Comparison as a socio-legal tool: A celebration of Reza Banakar and his work on methodology
The Sociology of Law Department arranges a series of research seminars inviting both local and international researchers who are conducting state of the arts research within various areas of law and society.
The Law in Society Research Unit, University of Southern Denmark
This presentation takes backdrop against Reza Banakar’s work on socio-legal methodology, starting with his pathbreaking article “The Identity Crisis of a ‘Stepchild’” from 1998. Firstly, the presentation discusses Banakar’s engagement with socio-legal methodology. Through that discussion, the presentation identifies how little Banakar’s (and Banakar and Travers’) work discussed comparisons despite it was a fundamental sociological tool used in his own work. Banakar used dichotomies and comparisons as tools in his argumentation, i.e. between law and sociology, inside and outside, lawyers and sociologist, lawyers and theocratic power in Iran, the strength and weaknesses of different socio-legal methodologies, etc. Secondly, the presentation discusses comparison as a socio-legal method and how it has been considered in literature on methodology. Thirdly, the presentation outlines a way comparison could be practised as a socio-legal tool.
